Courts and Judges: Our Overlords
Nine unelected lawyers control more and more of our lives. And 307 million of us acquiesce to it with barely a peep of debate. They are our Overlords. For 20, 30, 40 years, sometimes more, they can make sweeping pronouncements and rewrite the Constitution. They can invent new rights, obliterate others. We need a national debate about the wisdom of this.
Are all 307 million of us so stupid and mean that we can’t be trusted with self-government? At a minimum, we must understand that our votes for Senator and President are indirect “votes” for federal judges, all of whom are selected by the President and then must be confirmed by vote of the Senate. Who do you want your Overlords to be? Think about that when you vote.
We need an independent judiciary. That much is agreed. But how that plays out in practice? Let the Tough Love debate begin.
